The Supreme Court made an order directing the Colombo Chief Magistrate to terminate proceedings against Railway General Manager P P Wijesekera and discharge him from the case in the Colombo Magistrate's Court.
The Bench comprising Chief Justice Asoka de Silva, Justice Nimal Gamini Amaratunga and Justice K Sripavan also made an order that the petitioner Wijesekera could now seek to have himself reinstated as the General Manager Railways by the appropriate authorities.
Railway General Manager P P Wijsekera filed a Writ Application before the Supreme Court challenging the institution of proceedings against him before the Colombo Chief Magistrate's Court by the Director General of the Bribery Commission, on charges of alleged corruption.
In his petition Wijesekera has challenged the legality and propriety of the institution of proceedings against him by the Director General of the Bribery Commission, at a time when the Commission was non existent and defunct.
Deputy Solicitor General Shavindra Fernando who appeared with Deputy Solicitor General Sanjay Rajaratnam for the Director General of the Commission informed Court that the Director General had considered the matter and that they would forthwith withdraw the charges issued against Wijesekera.
Senior Attorney Sanjeeva Jayawardena with Rajeev Amarasuriya instructed by Amarasuriya Associates appeared for the Railways General Manager P P Wijesekera.
