Kumar Rupasinghe's case against ANCL dismissed

Colombo District Judge P A D Ganepola yesterday dismissed the action filed by Kumar Rupasinghe against the Associated Newspapers of Ceylon Limited (ANCL) with costs.

Rupasinghe had filed an action against ANCL in connection with an article published in the Dinamina on May 23, 2008 and claimed Rs 50 million.

This is the second occasion that Rupasinghe's action was dismissed. Earlier, the court dismissed the action filed by Rupasinghe as he and his lawyers were absent in court on the date the case was called.

Senior Counsel for ANCL submitted to court that the application by the plaintiff to reopen the case was outdated and not within the law and to dismiss the plaintiff's application.

Attorney Dhammika Abeygunawardena with attorneys Maura Gunawansa instructed by Sanjeewani Kasthuriarachchi appeared for the plaintiff.

President's Counsel Palitha Kumarasinghe with attorneys Ajith Siriwardena and Sudharshi Kariyawasam appeared for ANCL.
