Milk powder issue: enjoining order issued against DiSTRIBUTING AND PASTING posters

The Colombo District Court yesterday issued an enjoining order preventing "Jathiya Surakeeme Sangamaya" from distributing and pasting posters that bring disrepute to Fonterra brand Lanka Pvt. Ltd, the company that imports milk powder products.

Colombo District Judge Sisira Ratnayake made this order following a complaint filed by the company which imports, process es and distributes milk powder brands such as Anchor, Rathee, Red Cow, Anlene and Newdale brand yogurt. It cited Chaminda Rohana Ubayasekera a member of the Jathiya Surakeeme Sangamaya as defendant

In this plaint supported by Romesh de Silva PC with Sugath Caldera on the instruction of Sudath Perera Associate stated that the defendant organization is carrying out a false and malicious campaign to bring disrepute to plaintiff company following an alleged news on contaminated milk in China. Fonterra Brands Lanka stated that it is a fully owned subsidiary of the Fonterra cooperative group of New Zealand and it never imports milk from China.

The plaintiff also stated that the crisis with regard to milk was limited to China and to the countries where the goods are manufactured using milk from China. In the wake of this situation several Asian countries which had imported China manufactured milk started several safety measures, such as withdrawal of milk products from China. The government as precautionary measure decided to test samples of milk powders sold in Sri Lanka by manufacturers and distributors. Subsequently the defendent organization has pasted posters in and around areas of Colombo complaining that the plaintiff milk product is harmful for the consumption and they should be banned.

The plaintiff claimed that the alleged poster campaign was carried out by the members of the organization called Jathiya Surakeeme Sangamaya and stated that they have no right to distribute and paste posters against the plaintiff products and it has caused damages to the goodwill and reputation of its enterprise. The plaintiff asked to issue orders preventing the defendant from engaging in false and baseless campaigns against its business and estimated damage at Rs. 1000 million. The court issued the enjoining order and issued notice on the defendant

We all should hope that this "organization would also make the public aware on other " relevant issues "!!! They cannot make "selected protests" for "selected issues only". Since this is an issue concerning the lives and well being of little infants, urgent measures should be taken by the government to test randomly all milk product brands urgently and proclaim the results to the general public on a very high priority urgent basis, if there is any sort of contamination of the milk food products.
But knowing how we Sri Lankans operate these days, with the greed for money and the abuse of powerful politicians. We can only cross our fingers and hope for the best.

Mewa bahu jathika kumanthrana, do not dare to buy sri lankan products.

We do not warry about content of coca cola and drink
We do not warry about 4000 toxic in cigarettes and we enjoy it
